Agreement to these terms

These Terms of Service ("Terms") govern your use of medcareagency.net and any services MedCare Agency ("MedCare", "we", "us") provides to you. By using the site or our services you agree to these Terms. If you are using them on behalf of a clinic or company, you confirm you have authority to accept these Terms for that organisation.

Our services

MedCare provides website design and development, hosting and maintenance, medical SEO, local SEO, conversion optimisation and related marketing services for healthcare practices. The specific scope, deliverables and fees for each client are set out in a proposal, order form or service agreement ("Order"). If an Order conflicts with these Terms, the Order controls.

Free audits and free trials

Free website audits are provided for information only and do not create a client relationship. Free trials last for the period stated in your Order (currently three months) and require no credit card. At the end of a trial you may continue on a paid plan or end the service at no charge. We may change or end free offers at any time for future sign-ups.

Fees and payment

Paid plans are billed monthly in advance in US dollars unless your Order says otherwise. Fees are non-refundable except where required by law or stated in your Order. Plans are month-to-month and may be cancelled with 30 days' written notice.

Your responsibilities

• Provide accurate information and timely access to the content, accounts and approvals we need.
• Make sure the content you give us, including clinical claims, is accurate and that you have the right to use it.
• Review medical content before it is published. Your clinicians remain responsible for medical accuracy and clinical decisions.
• Use our services in compliance with applicable laws, including healthcare advertising and privacy laws.

HIPAA and patient information

Where our services involve creating, receiving, maintaining or transmitting protected health information on your behalf, we will sign a Business Associate Agreement with you before that work begins. See our HIPAA Compliance Notice and BAA Info pages for details.

Intellectual property

Once you have paid all fees due, you own the final website content and design assets we create specifically for you, excluding third-party software, themes, plugins, fonts and stock media, which remain subject to their own licences. We keep ownership of our pre-existing tools, methods and know-how, and may show non-confidential work in our portfolio unless you ask us not to.

Results and disclaimers

Search rankings, traffic and bookings depend on many factors outside our control, including search engine algorithms and competition. We do not guarantee specific rankings or results. Our services and website are provided "as is" to the fullest extent allowed by law. Nothing on this website is medical or legal advice.

Limitation of liability

To the fullest extent permitted by law, MedCare will not be liable for indirect, incidental, special or consequential damages, or for lost profits or data. Our total liability for any claim relating to the services is limited to the fees you paid us in the three months before the claim arose.

Termination

Either party may end a paid service with 30 days' written notice. We may suspend or end services immediately if fees remain unpaid or if the services are used unlawfully. On termination we will help you transfer your website and data in a reasonable format.

Changes and contact
